Economic and legal innovations to meet climate challenges

Special issue of Revue d'Économie Industrielle

Background and purpose of the special issue

The aim of this special issue of the Revue d'Économie Industrielle, which follows on from a seminar held at the Banque de France in April 2024, is to examine how economic policies and legislative and jurisprudential developments affecting businesses can come together to form a landscape conducive to an effective and fair response to the challenges of climate change.

This special issue will explore the pivotal role of the state in driving the behavioral changes needed to mitigate the effects of climate change and adapt to this new reality. Where do we stand in the field of public-powered "green" innovation, particularly in terms of the role of industrial policy in stimulating technological innovation?

At the heart of the debate is the delicate balance between implementing effective standards and public policies, and respecting public freedoms such as entrepreneurial freedom. How can decision-makers navigate this complex space, while ensuring a fair and equitable transition?

It is also important to examine how economic and social players, and in particular companies, can appropriate these new standards and obligations, taking the duty of care as an example. What strategies and innovations can they adopt to not only comply with these requirements, but also transform them into opportunities for sustainable growth? Particular emphasis will be placed on the judicial system, now on the front line in the face of these upheavals. How can the justice system support and frame these transformations? What is its role in developing a legal framework adapted to the challenges of climate change? What incentives have been or will be provided to economic agents to encourage transition?

Given that companies are at the heart of this transformation, and given its multidisciplinary approach, the Revue d'Économie industrielle is the ideal journal to host this special issue, which will be aimed at policy-makers, lawyers, economists, entrepreneurs and all those interested in how innovation, both economic and legal, is shaping our response to climate challenges.

Contributions are invited to illustrate these different components, with the aim of bridging the gap between law, economics and finance:

- Dynamics of "green" technological innovations ;

- Theoretical foundations of "green" industrial policies, from an economic and legal point of view ;

- Corporate duty of care, at national level, as well as within "value chains" at international level;

- Compliance law" and the commitments of companies and governments to the transition ;

- Role of the judicial system, both ex post (sanctions) and ex ante (in setting incentives) in achieving a low-carbon economy;

- Company assessment and sustainable environmental performance
